Terms of Service — Milpa

Overview
Welcome to milpa.nl. These Terms of Service govern your use of our website and the purchase of our products. By placing an order you agree to these terms. Milpa is a food brand based in Amstelveen, Netherlands, registered at the Dutch Chamber of Commerce (KVK).
1. Our products
All tlacoyos are handcrafted in small batches in Amstelveen. Product appearance may vary slightly between batches due to the handmade nature of the product. We reserve the right to adjust recipes, formats or availability without prior notice.
2. Orders
Placing an order is an offer to purchase. Your order is confirmed once you receive a confirmation email and payment is processed. We reserve the right to cancel or refuse any order. For perishable products, orders cannot be cancelled once confirmed and in production.
3. Prices and BTW
All prices are in euros and include 9% BTW (Dutch VAT) in accordance with Dutch tax law. Milpa's BTW number is available upon request. Prices may change without prior notice. The price at the time of your order confirmation is the final price.
4. Shipping and delivery
We ship within the Netherlands only. Orders are shipped Monday and Tuesday via PostNL standard delivery. Delivery times are estimates and not guaranteed. Once your order is handed to PostNL, risk of loss passes to you. Milpa is not responsible for delays caused by PostNL or circumstances beyond our control.
Refrigerate your order immediately upon receipt. Milpa is not responsible for quality issues resulting from failure to store the product correctly after delivery.
5. Local pickup — Amstelveen
Local pickup is available at our production address in Amstelveen on agreed days and times. Pickup must be arranged at the time of ordering. Please inspect your order at the moment of collection.
6. Returns and refunds
Please refer to our full Refund Policy for details. In summary: as perishable food products, tlacoyos cannot be returned. Refunds are only issued if the product arrives damaged or in poor condition, with photographic evidence submitted within the product's shelf life.
7. EU consumer rights
Under EU Directive 2011/83/EU, the standard 14-day cooling off period does not apply to perishable food products. By purchasing from Milpa you acknowledge this exception.
8. Intellectual property
All content on milpa.nl — including text, images, logo and brand identity — is the property of Milpa. You may not reproduce or use any content without prior written consent.
9. Limitation of liability
To the fullest extent permitted by Dutch law, Milpa is not liable for indirect, incidental or consequential damages arising from the use of our products or website. Our liability is limited to the value of your order.
10. Privacy
We collect and process personal data in accordance with our Privacy Policy and Dutch and EU data protection law (AVG/GDPR). Your data is used solely to process and deliver your order.
11. Shopify
This store is powered by Shopify. All sales are made directly with Milpa. Shopify is not responsible for any aspect of transactions between you and Milpa.
12. Governing law
These Terms are governed by Dutch law. Any disputes shall be submitted to the competent court in Amsterdam, Netherlands.
13. Changes to these Terms
We may update these Terms at any time. The current version is always available at milpa.nl. Continued use of the website after changes constitutes acceptance.
